Re: Penalty Notice No. 3069930 — Request for Screening Review
I am Kailiang Zhang, one of the two owners named on this Penalty Notice for 141 Woodbine Pl, Oshawa (the other is my wife, Lixia Zhang). I respectfully request that this penalty be cancelled on the grounds set out below.
Part 1 — The penalty was issued during the compliance period granted by the City's own Order.
On July 24, 2026 at 10:29 a.m., Municipal Law Enforcement Officer Brock Mathieson issued an Order (Complaint # CELOTM202625125) concerning long grass/weeds and waste at our property. The Order required compliance "on or before July 28, 2026 at 06:00 AM" and stated that "Failure to comply with this Order may also result in Administrative Penalties or penalties as prescribed by the Provincial Offences Act." In other words, the City's own document set a compliance window and framed administrative penalties as the consequence of failing to meet it.
Penalty Notice 3069930 was nevertheless issued on July 25, 2026 at 6:04 p.m. — approximately 32 hours after the Order was served and almost three days before the Order's own deadline had arrived. The Notice's remarks state the offence date as July 23rd, i.e. the very condition the Order had just given us until July 28 to remedy. We were never in default of the Order; there was nothing we had failed to comply with when the penalty was written.
Part 2 — A telephone extension to August 2 had been granted that same day.
On July 25, 2026 at approximately ⚠[时间, e.g. 11:00 a.m.], our son Cehan Zhang called Municipal Law Enforcement at 905-436-3311 ⚠[如记得分机或姓名补上] about the Order. He explained that the front-yard planting is a cultivated vegetable and herb garden planted by my wife. The officer on that call advised that the compliance date would be extended to August 2, 2026. We relied on that extension in good faith. The City later called back to advise that it maintained its position and required cutting, which we then completed — still within the extended time.
I respectfully ask the Screening Officer to review the officers' notes and call records for Complaint # CELOTM202625125 and this Notice, which should confirm both the call and the extension. A contemporaneous memorandum of both calls is enclosed (Exhibit E).
Part 3 — Full compliance, first notice, immediate cooperation.
All grass and weeds on the lot and the abutting boulevard were cut below 20 cm, and the items listed in the Order were removed, on ⚠[修剪完成日期, e.g. July 29, 2026] — within the extended compliance period. Dated photographs are enclosed (Exhibit D). This is the first notice of any kind we have received at this property, and we acted on it immediately.
Background. The planting at issue was not neglect: it is a tended kitchen garden — mint, chives, strawberries and coriander on drip irrigation, planted by my wife, who has limited English (Exhibit C). Our son raised exactly this on the July 25 call. While we have cut everything back to cooperate with the City's position, we note this context because it explains our good faith throughout, and we do not concede that a cultivated garden constitutes "weeds".
Requested outcome. Given that the penalty (i) was issued before the City's own compliance deadline, (ii) contradicted a telephone extension granted the same day, and (iii) concerns a condition that was fully remedied within the time the City allowed, I request that the penalty be cancelled. In the alternative, I ask that it be reduced and the matter confirmed closed, the property now being fully compliant.
